Can I get a document notarized without valid identification?
Yes. Under certain circumstances it is possible. It will require two credible witnesses whom personally know the signer. They will both need a valid ID and take an oath.
To sign without ID, the following must apply for the signer:
- The individual appearing before the notary public as the signer of the document is the person named in the document
- The credible witness personally knows the signer
- The credible witness reasonably believes that the circumstances of the signer are such that it would be very difficult or impossible for the signer to obtain another form of identification
- The signer does not possess any of the identification documents authorized by law to establish the signer’s identity
- The credible witness does not have a financial interest and is not named in the document signed
Can I still get a document notarized if I am unable to sign my name?
Yes. It is called a signature by mark. The signer will need to mark the document in some way where they would normally sign.
This mark can be something simple like an “X.” But it is required that the document is signed (marked) in some way. The signer can write it, use their thumbprint, or sign (mark) the document with the pen in their mouth.
The process requires two witnesses that do not have a financial interest and are not named in the document being signed. The witnesses do not need to personally know the signer.
